Malabar Magic Ocean Swim Waiver
Risk Warning pursuant to Civil Liability Act 2002 (section 5M)
The Murray Rose Malabar Ocean Swim takes place in the open ocean and is conducted off Malabar Beach in Malabar Beach. Ocean swims are demanding and potentially dangerous events. Risks of injury or harm may arise in numerous ways, including, but not limited to drowning, natural obstacles, man-made or controlled obstacles, ocean craft, attack by marine animals (i.e. shark, bluebottle etc) and the condition of the ocean and the weather generally (i.e., ocean temperature, storms, lightening, currents or encountering rough water).
Participants, enter the Murray Rose Malabar Magic Ocean Swim at their own risk.
Participants should have a medical check prior to entering the Murray Rose Malabar Ocean Swim and prepare for the event by training. Water safety craft will patrol the course for the duration of the Ocean Swim. If a participant feels unable to proceed further in the swim, the attention of the water safety personnel should be sought. The Murray Rose Malabar Ocean Swim organisers cannot guarantee your safety. The Murray Rose Malabar Ocean Swim organisers reserve the right to bring to shore by the water patrol any participants which they deem to be incapable of competing further in the Ocean Swim. While in the competition area - including the beach and water environments - participants must follow all directions of Randwick Lifeguards and Murray Rose Malabar Ocean Swim organiser officials and water safety personnel. However, participants must be aware that certain risks, such as attacks by marine animals including sharks or changes in current and ocean conditions, can arise without warning.
Agreement waiver and indemnity pursuant to Civil Liability Act 2002 (section 5M)
1. I acknowledge that the Murray Rose Malabar Magic Ocean Swim (Ocean Swim) is a recreational activity and that, notwithstanding recreational services are supplied to me in the Ocean Swim, participation in the Ocean Swim is at my own risk.
2. I acknowledge that I have been provided with, read, and understood the risk warning in relation to the Ocean Swim and understand and agree that the Open Swim is conducted in open water. While lifesaving services will be present on the beach and in the water, my condition and progress in the Ocean Swim cannot be individually monitored.
3. This waiver release and discharge shall operate jointly and severally in favour of the following: Namely: Rainbow Club Australia Ltd, Rainbow Club Swim Committee, Randwick Municipal Council, Randwick Council Lifeguards, The Surf Life Saving Association of Australia, and any of their State Centres, Branches, affiliated Surf Life Saving Clubs and committees, sponsors, supporters, persons, corporations, contractors, subcontractors, servants, and employees involved or otherwise engaged in promoting, staging, administering, running, or controlling the Ocean Swim (the Indemnified Parties).
4. In consideration of my entry in the Ocean Swim, I the undersigned for myself, my heirs, executors, and administrators agree that: I hereby waiver, release and discharge The Indemnified Parties for each and every claim, right or cause of action for which I might have or arising out of my death, injury, of any description whatsoever which I may suffer or sustain as the result of my participation in the Ocean Swim, whether caused by me or act or omission (including deliberate or negligent acts or omissions) of the Indemnified Parties.
5. I agree to indemnify the Indemnified Parties and keep indemnified against all actions, suits, demands, claims, proceedings, costs, expenses, liabilities, and judgements arising out of or in relation to my participation in the Ocean Swim. I consent to receive such medical aid or preventative treatment which may be deemed advisable in the unfettered discretion of the race Medical Officials and Lifesavers in the event of any injury, accident, or illness to me as the result of my participation in the Ocean Swim.
6. I affirm that I have properly trained for and fully satisfied myself as to my physical and medical condition to compete in the Ocean Swim.
7. I agree to abide by and accept the rules and regulations of the Ocean Swim whether announced on the day or prior thereto and to accept the decisions of the Event Committee.
8. I consent to the free use of my name or photograph in any newspaper, promotional advertising material, video, telecast and digital platforms (including social media) taken by or on behalf of Rainbow Club Australia and/or its sponsors.
9. I Agree to be contacted by Malabar Magic Committee regarding upcoming events and information regarding the swim.
Note: The organiser of the Murray Rose Malabar Magic Ocean Swim is Rainbow Club Australia Inc. Your online entry is taken on behalf of Rainbow Club Australia Inc.
Entry fees to ocean swims are not refundable in the event of cancellation or postponement due to conditions on swim day. A decision on refunds will be made by the event organiser if necessary.
I have read, understand and agree to the 2023 Malabar Magic Ocean Swim Participant Waiver, which forms part of the contract between RCA and me, either as the participant or as an authorised person, authorised by the participant to sign on their behalf.
